Terms and conditions of use

Payment methods:

Once payment has been made by one of the methods accepted by the system (credit card, PayPal, etc.) we will start to arrange the shipment.

Shipments:

Ordinary shipments are free of charge for the entire Italian territory; international European shipments will cost from € 35.00 and extra-European shipments must be agreed with our customer service at winetcompany@gmail.com. Shipments will leave from Monday to Wednesday, unless specifically requested in writing, to avoid the goods remaining with the couriers during the weekend and generally take 48 working hours. You will be provided on request with any further information including tracking by contacting winetcompany@gmail.com. On the customer's express written request, shipments can also be made on non-stipulated days.

If the customer is interested in information that is not present on the site, he/she can request it simply by writing an e-mail message to our mail: winetcompany@gmail.com or by contacting the winetcompany Instagram page.

'Seen and liked' clause:

The Winet Company carries out a strict selection of our products based on objective parameters inherent to preservation and quality; however, being aware that we trade in bottles of very old vintages, a customer who is not convinced of the state of preservation will be required to return, at his own expense, the bottle before opening it, being entitled to a bottle exchange.

Ownership of Products:

Right of withdrawal:

1. Right of withdrawal: the User has the right to withdraw from the contract without stating reasons, within 14 days. The withdrawal period expires after 14 days from the day of delivery by the Courier. In order to exercise the right of withdrawal, the User shall inform the Holder of the decision to withdraw by means of an explicit declaration sent to the e-mail winetcompany@gmail.com .
For bottles that have already been opened by the customer, we reserve the right to exchange only bottles with corkage problems and current vintages. The customer will be obliged to send back the bottle (with cork and liquid. The latter must be at least 2/3 full) so that a check can be made on the veracity of the problem with a view to a possible refund.

Effects of withdrawal:

If the User withdraws from this contract, he/she shall be refunded all payments he/she has made to the Holder, including delivery costs (except for additional costs resulting from any choice of a type of delivery other than the least expensive type of standard delivery offered) no later than 14 days after the day on which the Holder takes possession of the goods. Such refunds will be made using the same means of payment used by the User for the initial transaction unless the User has expressly agreed otherwise; in any case the User shall not incur any costs because of such a refund. The User is requested to return the goods and deliver them to the Holder without undue delay and in any case within 14 days from the day on which he communicated his withdrawal from this contract. The deadline is met if the User returns the goods before the expiry of the 14-day period. The User is only liable for the decrease in value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics and functioning of the goods. The costs of returning the goods shall be borne by the User.

Limitazioni al diritto di recesso:

Returned products that are damaged or used in a different and additional way to what is strictly necessary to establish their nature, characteristics and functioning shall be refunded after deduction of the decrease in value resulting from the damage or use. Reimbursement is excluded when the decrease in value is total. The right of withdrawal is in any case excluded in relation to:

• made-to-measure or clearly customised goods;
• the supply of goods that are liable to deteriorate or expire rapidly;
• the supply of sealed goods that are not suitable to be returned for hygienic or health protection reasons and have been opened after delivery.

Indemnification and limitation of liability

The User undertakes to hold the Owner harmless (as well as any subsidiaries or affiliates thereof, its representatives, directors, agents, licensors, partners and employees), from any obligation or liability, including any legal fees incurred in defending itself in court, which may arise from damages caused to other Users or third parties, in connection with the content uploaded online, violation of the law or the terms of these terms of service.

Limitations of liability:

winetcompany.it and all accessible functionalities are made available to Users, at the terms and conditions set forth in the Contract, without any guarantee, explicit or implicit, that is not compulsory by law. No guarantee of suitability of the services offered for the purposes intended by the User is provided. The use of winetcompany.it and of the accessible functionalities is carried out by Users at their own risk and under their own responsibility. In particular, the Owner, within the limits of the applicable law, shall be liable for damages of contractual and extra-contractual nature towards Users and third parties exclusively by way of wilful misconduct or gross negligence when they are an immediate and direct consequence of winetcompany.it activity. Therefore, the Owner shall not be liable for:

• any loss which is not a direct consequence of the breach of Contract by the Holder;
• any loss of business opportunity and any other loss, including indirect loss, that the User may suffer (such as, by way of example but not limited to, commercial losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill value etc.);
• or damages or losses deriving from interruptions or malfunctioning of the website due to force majeure events or, in any case, to unforeseen and unforeseeable events and, in any case, independent from the will and outside the control of the Owner such as, by way of example but not limited to, breakdowns or interruptions to telephone or electricity lines, the internet network and/or, in any case, other transmission instruments, unavailability of websites, strikes, natural events, viruses and computer attacks, interruptions to the supply of products, services or applications of third parties and incorrect or unsuitable use of the site by Users or third parties.

Multimedia material:

The photos included are indicative and may not constitute an exact representation of the products. The Owner shall do his best to present the characteristics of the products with the highest degree of detail possible on winetcompany.it within each tab corresponding to the product viewed by the User. However, the images and colours of the products offered for sale on winetcompany.it could differ from the real ones due to several factors, among which, by way of example and not exhaustive, User's terminal monitor, photographic filters, etc. Therefore, the User acknowledges and accepts that such possible minor differences do not constitute a lack of conformity of the products.
